Who we are. “James Tanner,” “we,” “us,” and “our” mean James Tanner and jamestanner.us, including our agents, vendors, contractors, and affiliated organizations.

Scope. These terms apply when you submit a form, text in, call us, or otherwise opt in to receive emails, SMS/MMS messages, or voice calls from us.

1) Your Consent to Communicate

By providing your email address and mobile or landline number and by clicking submit, checking a box, or otherwise affirmatively opting in, you agree that we may contact you by email, SMS/MMS, and voice. This may include informational and marketing messages. Messages may be sent using an automatic telephone dialing system and may include artificial or prerecorded voice. 3) How to Withdraw Consent

You may opt out of SMS/MMS at any time by replying STOP. You may opt out of email at any time by clicking the unsubscribe link in any email. You may ask to be placed on our internal Do Not Call list during any call or by emailing [email protected]. You may revoke consent by any reasonable method. (FCC Docs)

4) Privacy Notice

Data we collect. Contact details, message content, interaction logs, device and carrier information, IP address, and form data you submit.
How we use it. To send messages you request, to service your account, for marketing with your consent, for compliance, fraud prevention, analytics, and record-keeping.
Sharing. We may share with service providers who send email, SMS/MMS, or voice on our behalf. We do not sell your personal information.
Retention. We keep data as long as needed for the purposes above or as required by law.

Security. We use reasonable safeguards to protect your information. No method is 100% secure.

5) Permissible Use and Age

You must be 18 or older to subscribe. Certain content is restricted by carrier policies and law. We follow carrier messaging policies and applicable industry rules. (Twilio)

6) Charges and Your Responsibility

You are responsible for all charges from your carrier or service provider related to our communications, including data, text, and voice rates. You agree we are not responsible for any charges, costs, damages, or fees that result from our communications or your use of our services.

7) Hold Harmless and Limitation of Liability

To the maximum extent permitted by law, you agree to hold harmless, indemnify, and defend James Tanner, jamestanner.us, and any affiliated organizations, and our officers, employees, agents, contractors, and partners from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from or related to our communications with you, your use of our services, your breach of these terms, or violation of law.

We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages. Where liability cannot be disclaimed, it is limited to one hundred dollars.

8) Dispute Resolution, Fee Responsibility, and Class Action Waiver

Arbitration. Any dispute or claim arising out of or relating to these terms or our communications will be resolved by binding arbitration on an individual basis. Arbitration will take place in Maricopa County, Arizona, before a single arbitrator. The Federal Arbitration Act governs. Judgment on the award may be entered in any court with jurisdiction.

Fees. To the maximum extent permitted by law, you agree that you will be responsible for all attorneys’ fees, arbitration fees, expert fees, and court costs incurred in any dispute, regardless of outcome. If any part of this fee provision is found unenforceable, the remainder will still apply to the extent allowed by law.

Class waiver. You waive the right to participate in a class, collective, consolidated, private attorney general, or representative action. Only individual claims may be brought in arbitration.

9) Compliance With Law

We strive to comply with the Telephone Consumer Protection Act and related FCC rules, CTIA best practices, A2P 10DLC requirements, and FTC rules for commercial email. You agree that your opt-in provides the consents described in Section 1. Regulatory guidance continues to evolve. We update our practices as rules change. (FCC Docs)

10) Changes to These Terms

We may update these terms at any time. Changes apply when posted on jamestanner.us. If changes materially affect your rights, we will give notice by email or text where possible. Your continued subscription after notice means you accept the changes.
